Long-distance runner Evie Parts sued the NCAA and Swarthmore College for expelling her from the team in an "intolerant" manner. The athlete claims she was illegally kicked out and only because she is transgender.

Parts argues that the NCAA's ban on transgender athletes competing in women's sports is not legally binding, as it is not a government organization and therefore has no jurisdiction over Pennsylvania state law.

Trump jokes about transgender athletes in college speech

It should be remembered that Donald Trump signed an executive order in February aimed at prohibiting transgender women from competing in women's sports, one of his main campaign promises.

Parts was kicked off the team on February 6, the day the NCAA, the largest governing body for collegiate sports in the United States, issued its new policy on transgender athletes, following an executive order from the US president.

The lawsuit also names other individuals, including athletic director Brad Koch, as the athlete alleges that their decisions led her to a depressive state and to self-harm.

"We support the allegations in the complaint," said Susie Cirilli, an attorney representing Parts. "As alleged in the complaint, the NCAA is a private organization that issued an intolerant policy. Swarthmore College chose to follow that policy and ignore federal and state laws."
